Terms of service

These General Terms and Conditions of Sale and Use (hereinafter referred to as "GTC") govern the relationship between, on the one hand, BRM AGENCY LLC, registered under number 211 57 27, with its registered office at Sharjah Media City, Sharjah, United Arab Emirates, trading under the name MAYBE PARIS (hereinafter referred to as "MAYBE PARIS"), and, on the other hand, any natural person acting in a non-professional capacity who has visited and/or made a purchase on the website www.maybe-paris.co (the "Site"), hereinafter referred to as the "User".

As a preliminary matter, it is necessary to define the terms used in these GTC.

 

ARTICLE 1 - DEFINITIONS

The following terms, when used in the CGV with a capital letter, shall have the meaning assigned to them in this Article, whether used in the singular or plural.

Client: any Site user who has a customer account on the Site and/or who makes a purchase of a Product through the Site. Each Client is a User of the Site.

Order: the process by which the Client selects the Products he/she wishes to purchase. This Order is finalized when the Client has chosen the products he/she wishes to have delivered as well as the delivery options and when he/she has finalized the payment for these products.

Product: refers to any product that can be viewed or purchased on the Site by a User. It may be a product present on the Site and not yet purchased by the User, or a product present (or not) on the Site and purchased by the User.

User: any natural person who accesses the Site, regardless of whether he/she is a Client or not.

ARTICLE 2 - PURPOSE AND SCOPE OF APPLICATION OF THE CGV

These CGV are accessible at any time on the Site. They aim to define the conditions for Order, payment, delivery, and management of any returns of Products ordered by Clients, as well as the conditions under which Users may access or use the Site.

These CGV are systematically communicated to any Client prior to placing an Order and shall prevail, where applicable, over any other version or contradictory document.

The Client declares that he/she has read and accepted these CGV before placing his/her Order. The validation of the Order by the Client constitutes acceptance without restriction or reservation of these CGV.

When he/she visits any part of this Site without placing an Order, each User agrees, without restriction or reservation, to comply with these CGV.

ARTICLE 3 - CURRENT VERSION OF THE CGV

The CGV may be subject to subsequent modifications to take into account any administrative injunction or recommendation, as well as any legal, jurisprudential, and/or technical developments.

In any case, the version of the CGV applicable to the Client's purchase is the one in force on the Site at the date of placing the Order. The new version of the CGV will be binding on Users of the Site and Clients from the date of their publication and cannot apply to transactions concluded previously.

ARTICLE 4 - SITE USE CONDITIONS

The Site is hosted on Shopify Inc, the provider of the e-commerce digital platform that enables MAYBE PARIS to present and sell its Products and services.

By accepting these CGV, the User declares that he/she has the required capacity to contract and acquire the Products offered on the Site.

MAYBE PARIS does not intend to sell the Products on the Site to professionals, but only to consumers or non-professionals, for their personal needs. MAYBE PARIS may reduce or refuse orders for the same Product (or several Products) placed, in particular in significant quantities, using the same credit card and/or the same billing and/or shipping address.

The User agrees not to use the Products or services of this Site for any illegal or unauthorized purpose.

The User agrees not to jeopardize the proper functioning of the Site by using computer means such as worms, viruses, or any other code or computer process that may be harmful to the Site.

The Site service, its operation, as well as any part or content of the Site service, may be interrupted at any time by MAYBE PARIS, without notice or any other prior information to the User. MAYBE PARIS is not responsible for any suspension or interruption of the service, any part of the Site service, or its operation.

ARTICLE 5 - PRODUCT DESCRIPTION

The Products offered for sale are those presented on the MAYBE PARIS Site.

The main characteristics of the Products, including the essential specifications, illustrations, and indications of dimensions or capacity of the Products required by applicable regulations, are presented on the Site in the description section.

The Client must refer to the description of each Product in order to know its properties and essential characteristics before placing an Order. The choice and purchase of a Product are the sole responsibility of the Client.

The User declares to be informed that photographs of the Products are present on the Site, and that they allow for as clear a display as possible of the appearance of the Products, particularly with regard to their color.

However, the User acknowledges that MAYBE PARIS cannot guarantee that the Products as displayed on the User's terminal and as received will be exactly identical to the photographs, due in particular to technical constraints in making the photographs available on the Site.

Product offers are valid within the limits of available stocks, as specified when placing the Order.

For all Products shipped outside the European Union and the French Overseas Departments and Territories, the price will be calculated excluding taxes on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. They will be the responsibility of and are solely the Client's responsibility.

 

ARTICLE 6 - ORDER PROCESSING

Order placement

All orders are placed exclusively on the Site according to the following conditions.

To place an order, it is the Client's responsibility to:

Select on the Site the Products they wish to order and add them to their cart. The order can be placed without the need to create a personal account on the Site; Provide their contact details and delivery address; Choose the delivery method.

The Client has the possibility to check the details of their order, its total price, and correct any errors before confirming their order. The Client undertakes to provide up-to-date, complete, accurate, and exhaustive information regarding their contact details.

The recording of an order on the Site is carried out when the Client validates their order via the button provided for this purpose. This validation implies acceptance of the entirety of these T&Cs.

Order confirmation

The order is only final after MAYBE PARIS sends the Client, without delay, a confirmation of acceptance of the order by email to the email address indicated by the Client when placing their order, and after MAYBE PARIS has received full payment for the order.

Any order placed on the Site, validated by the Client and confirmed by MAYBE PARIS, under the conditions and according to the methods described above, constitutes the formation of a contract concluded remotely between the Client and MAYBE PARIS.

The Client can follow the progress of their order on the Site using the tracking number indicated by MAYBE PARIS in the email confirming their order.

Modification and cancellation of the order by the Client

Once confirmed and accepted by MAYBE PARIS under the conditions described above and in the process of being shipped, the order cannot be modified by the Client and cannot be cancelled by the Client except in the exercise of their right of withdrawal or in case of force majeure.

Modification and cancellation of the order by MAYBE PARIS

MAYBE PARIS reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to the payment of a previous order.

In the event of modification or cancellation of an order by MAYBE PARIS, MAYBE PARIS notifies the Client without delay by notifying/contacting them through the following means:

By email to the email address provided by the Client when placing their order; By phone at the phone number provided by the Client when placing their order.

In the event of cancellation of the order by MAYBE PARIS, the Client will be refunded within 14 days from the date of notification to the Client of the cancellation of the order.

ARTICLE 7 - PRICES

Applied amounts

The prices of the Products applied to the Client correspond to those displayed on the MAYBE PARIS website at the time of the Client's order. The prices are expressed in Euros, all taxes included (VAT) and take into account the taxes applicable on the day of the order.

They also take into account any discounts that MAYBE PARIS may offer and that are indicated on the website. Any announcement of a price reduction will indicate the price practiced by MAYBE PARIS before the application of the price reduction.

The rates do not include processing fees, shipping, transportation, and delivery fees, which are invoiced in addition, in the conditions indicated on the website and calculated prior to the order being placed.

The User acknowledges and accepts that the price of the Products may be modified without prior notice. In particular, these modifications may occur due to variations in the prices of raw materials, logistics costs, or any other reason.

Delivery fees

Delivery fees, including taxes, are specified on the website and are indicated to the Client when placing the order. They are the sole responsibility of the Client. The Client is informed that delivery fees depend on the territory of the Product delivery address. They do not include any customs duties or other local taxes or import duties or state taxes that may be required, which will also be the responsibility of the Client.

Payment terms

Orders placed on the website are orders with an obligation to pay.

The price is payable in full on the day of the order by the Client, by means of a secure payment, according to the following methods:

By Paypal; By Apple Pay; By credit cards: Visa, MasterCard, American Express.

Payment by credit card is irrevocable, except in case of fraudulent use of the card. In this case, the Client may request the cancellation of the payment and the corresponding refunds.

MAYBE PARIS will not be required to deliver the Products ordered by the Client if the Client does not pay the full price in the above conditions.

Payments made by the Client will be considered final only after the effective receipt of the amounts due by MAYBE PARIS.

In addition, MAYBE PARIS may, in case of non-compliance with the payment conditions set forth above, suspend or cancel the delivery of orders in progress made by the Client. MAYBE PARIS may also refuse any order or delivery in case of refusal of payment authorization by credit card issuers, non-payment or partial payment.

Unless proven otherwise, the data recorded in the Shopify computer system for MAYBE PARIS constitutes proof of all transactions concluded with the Client.

ARTICLE 8 - DELIVERY OF ORDERED PRODUCTS

Delivery of Products

The Products are delivered to the address provided by the Client at the time of the Order.

The delivery times are indicated on the Site and specified at the time of the Order, including the processing, shipping, and delivery times of the Order. They may vary depending on the mode of delivery and the chosen territory. In any case, the Products are delivered within a period of 2 to 10 working days from the Order to the address indicated by the Client when placing the Order on the Site. In the event of a delivery delay due to a delay by the carrier, the Client will be informed as soon as possible.

Unless there is a specific case or unavailability of one or more Products, the ordered Products will be delivered at once.

The Client is informed that in the event of a temporary out of stock due to high demand, or in the event of a delay in shipment, delivery times may be extended.

Non-Delivery

In the event of non-delivery, the Client acknowledges and expressly agrees that he is required to provide any evidence of the absence of delivery. He undertakes to provide them as soon as possible to MAYBE PARIS so that MAYBE PARIS can, at its own discretion and based on the evidence provided by the Client, decide to resend Products identical to those ordered to the Client, without any additional costs to the Client.

In addition, if the ordered Products have not been delivered within the delivery time specified at the time of the Order, the Client may request the cancellation of his Order from MAYBE PARIS, after having put MAYBE PARIS in default to perform within a reasonable additional time not respected by MAYBE PARIS.

In the event of cancellation, the entire amount paid by the Client will be refunded to him no later than fourteen (14) days from the request to cancel his Order.

ARTICLE 9 - RECEIPT OF PRODUCTS BY THE CLIENT

The Client is required to check, upon receipt, the condition of the packaging and the conformity of the delivered Products.

The transfer of the risk of loss and damage relating thereto shall only take place at the time when the Client physically takes possession of the Products.

ARTICLE 10 - RIGHT OF WITHDRAWAL

In accordance with current legal provisions, the Client has a period of fourteen (14) days from the receipt of the Products to exercise their right of withdrawal with MAYBE PARIS, without having to justify reasons or pay penalties, for the purpose of exchange or refund.

Returns of Products must be made in their original and complete condition (packaging, accessories, manual...) allowing their resale as new, accompanied by proof of purchase and the return form. Returns must be made within 14 days from the notification to MAYBE PARIS of the Client's decision to withdraw.

Damaged, soiled or incomplete Products will not be accepted. In addition, for reasons of hygiene or protection of health and in accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal of the Client is excluded for Products that have been unsealed, meaning that the seal or closing device has been opened by the Client.

The right of withdrawal can be exercised with MAYBE PARIS via the online form or by email at the following address: contact@maybe-paris.co. An acknowledgement of receipt will be immediately communicated to the Client.

In the event of the exercise of the right of withdrawal within the aforementioned period, only the price of the purchased Products and delivery costs will be refunded, return costs remaining the responsibility of the Client.

The refund will be made within 14 days from the receipt of the returned Products by the Client at MAYBE PARIS.

 

ARTICLE 11 - PUBLICATION OF NOTICES

MAYBE PARIS offers Clients the possibility to publish reviews or comments on their purchases.

The objective is to provide Users with feedback on the use of MAYBE PARIS Products.

* Conditions for posting reviews

The Client undertakes not to post reviews that are:

* defamatory, abusive, obscene, offensive, violent or inciting to violence, political, racist or xenophobic and generally contrary to the laws and regulations in force, to the rights of persons or to good morals;
* infringing on the privacy of third parties;
* infringing on the copyright or any other rights of third parties.

No consideration is provided by MAYBE PARIS in exchange for the submission of a review.

Reviews are submitted either spontaneously by the User, or following a verified purchase record. In the latter case, they are reviews requested by MAYBE PARIS following an Order by a Client and via a review collection tool. The author of the review may modify or delete it.

In all cases, reviews are subject to moderation under the conditions described below.

* Classification of reviews

By default, the reviews are classified in chronological order, from the most recent to the oldest. The User can modify the display rules according to the sorting criteria proposed on the Site.

* Publication and conservation deadlines

A maximum period of 8 days is to be expected between the submission of the notice and its publication.

The notice remains online for a maximum period of 3 years from the date of its submission. They are then deleted or anonymized.

* Moderation

Reviews are subject to moderation by MAYBE PARIS which has the right not to publish or to delete comments including personal data of the author of the review or of third parties or comments which do not comply with the above rules.
MAYBE PARIS also has the right to refuse to publish a review if :

* the note does not correspond to the review ;
* the review submitted relates to a purchasing experience (customer service, delivery, website) and not to the product noted;
* the review contains random characters or is not understandable;
* the review is not related to the rated product;
* the review contains personal information or any other information that could lead to identity theft;
* the review encourages the purchase from a competitor;
* the review indicates that the User has not yet tested the product;
* the notice is intended to make a complaint;
* MAYBE PARIS believes that its civil or criminal liability may be incurred by maintaining the notice.

MAYBE PARIS may contact the author of the notice for verification purposes in case of doubt as to the authenticity of the notices.

* Authorization of exploitation

The author of the review authorizes, free of charge, the use of the comments and photos of which he is the author by MAYBE PARIS for use in connection with the marketing and promotion of the product on which it is based on the Site, partner pages, social networks, as well as on search engines, in particular those which publish reviews and comments and on all printed media, including in particular publications, catalogs, press, leaflets, flyers, POS.

To this end, the author of the notice grants MAYBE PARIS the following exploitation rights:

* Under the right of reproduction, directly or through a third party, the right to reproduce, to have reproduced, to put into circulation, to establish any copy, duplicate, without limitation of copy, in whole or in part, free of charge or against payment, on any paper, computer, electronic, audio, optical and/or any other current or future medium, by any current or future process.
* Under the right of representation, directly or through a third party, the right to represent, to have represented publicly, in whole or in part, free of charge or against payment, by all processes such as representation on screen, or any other process in all public or private places.
* Under the right of broadcasting, directly or through a third party, free of charge or against payment, the right to broadcast by radio, satellite, television broadcasting, by any means of cable operator or any other means of telecommunication, present or future. This right also includes broadcasting on internal networks and broadcasting in networks intended for a public not grouped within a legal entity such as Teletel and Internet networks.
* Under the derived rights, directly or through a third party, free of charge or against payment, the right to use, adapt, arrange, modify, translate and have used, adapted, arranged, modified, translated in whole or in part.
